Scope of POSH Act. Applies to all workplaces - public, private, organized, unorganized Includes employees, clients, customers, vendors, visitors Covers physical, verbal, and non-verbal harassment.
Definition of Sexual Harassment. Physical contact and advances Demand or request for sexual favors Making sexually colored remarks Showing pornography Any other unwelcome conduct of sexual nature.
Key Provisions. Prevention: Awareness programs and workplace policies Prohibition: Clear rules against harassment Redressal: Internal Complaints Committee (ICC) and Local Complaints Committee (LCC).
Complaint Process. Filing complaint within 3 months of incident ICC to complete inquiry within 90 days Report submission within 10 days of completion Action by employer within 60 days.
Duties of Employer. Constitute ICC in organizations with 10+ employees Display POSH guidelines at workplace Organize regular training and awareness programs Assist complainant in filing police complaint Submit annual compliance report.
Penalties for Non-Compliance. Fine up to ₹50,000 for not constituting ICC Higher fines for repeat offences Possible cancellation of business license.
