The second is the Promotion of Access to Information Act, which we will refer to as the PAI Act. It is a freedom of information law.

The first is the Protection of Personal Information Act, which we will refer to as The POPI Act.

The POPI Act and T he PAI Act hold a special relationship.  Both can be seen as "information" laws, and are each on one end of a continuum.

On the one end, PAIA is an "Access" law, all about Freedom of Information.  POPI on the other end, is about Privacy or the prevention of exposure of information.

Not at all. You can think of the POPI Act of more like a school ground supervisor than a policeman. Its not saying that you are not allowed to collect and process personal information, its merely adding rules that limit what you are allowed to do with that information. This is done to protect the privacy of all individuals involved

Does this mean that we are not allowed to have our friends and family’s contact details stored on our phones?

Information relating to the education or the medical, financial, criminal or employment history of the person; Any identifying to the person; The blood type or any other biometric information of the person ; The personal opinions, views or preferences. Correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence; The views or opinions of another individual about the person; and The name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person .
