ISSUE In this scene, we could see that Don is driving dangerously by exceeding the speed limit on the road. So, the issue that arises from this scene is about traffic offences. This is a violation of Section 42 (1) of the Road Transportation Act of 1987.According to Act 333, Road Transportation Act 1987 Section 42 (1), a traffic offence is any person who drives on a road recklessly or at a speed that is dangerous to the public. LAWS 1.National Law - National law consists of rules and principles which govern the relationship between citizens in a country. - Don is driving recklessly and dangerous to the public. - In this situation, the law that is being violated is the Transportation Act of 1987. 2.Public law - Public law governs the relationship between an individual and the state. - This law is to protect social interests -In this scene, it governs the relationship between Don as an individual and also the state. 3.Written law - Written law refers to legislation enacted by parliaments or state legislatures - In this case, the law that has been enacted by parliament is Act 333, the Road Transportation Act 1987..

LAWS. 4. LAWS Criminal Law Criminal law is the body of law that relate crimes and punishment. Traffic offence is not a crime under the penal code but it is still an offence under the Road Transportation Act 1987 Section 42 which is reckless and dangerous driving Substantive Law Substantive Law is the law that governs the right, duties and liabilities between citizens and government. It is the law that tell the do's and the don’ts. Don as a citizen of the state has duty to no commit the traffic offence as it stated in the Road Transportation Act Procedural Law Procedural Law is the law that govern the procedure in enforcement rights and duties of substantive law .As the scene is criminal act, criminal procedure should be applied in this matter.

SYNOPSIS/LEGAL ISSUE. 2. SYNOPSIS Rico is a Filipino citizen who lives and works in Malaysia. Rico has a mother and a sister in Filipino. One day, Rico's sister called him to inform him that his mother had fallen ill and needed to be admitted to the hospital. Rico's sister asked him for a huge sum of money to cover the cost of his mother's hospitalization. Rico does not have enough money and needs to borrow it from loan shark, named James. As a result, Rico asks his friend Marzuki to ask James for some money. James had given Marzuki a deadline to repay the money that Rico had borrowed from him. After the deadline has expired, James has been tracking Marzuki in order to reclaim his money. Then, James's employee, Zul , found Marzuki in a market. Zul chased and eventually caught Marzuki . Zul then asked Marzuki the whereabouts of James' money and Marzuki told him that the money was on Rico. Suddenly, Zul took Marzuki into the car, which was driven by James. They've dragged Marzuki to Rico's house to reclaim back James' money. Rico was unable to repay the money he had borrowed from James since he had no money after giving all of his money to his sister, who was in the Philippines, to pay his mother's hospital bills. Finally, Rico handed over all his savings to James, but it was not enough to pay back the money he had borrowed from him. Rico was beaten for failing to return back James' money. In conclusion, Rico had breached his contract by failing to pay his debts to James. LEGAL ISSUE Whether Rico had been involved in the breach of contract for failing to pay his debts to James..

Legal Issue: Breach of Contract in terms of Debts Classifications of Law: 1. Civil law - The body of law relevant to the issue is the law of contract. The law of contract governs disputes between two individuals whose are James and Rico. 2. Private law - It governs the relationship between Rico (the debtor) and James (the creditor). 3. Written law - The Contract Act 1950 statute which is enacted by legislature is being used under this legal issue. (Contract Act 1950 Act 136 Section 60) 4. Private international law - It involves the dispute between one Malaysian citizen (James) and one Filipino citizen (Rico) and so the Malaysian law is applicable here (as the scene happens in Malaysia). 5.
