Scene 3

In 2015 a restraining order was placed against my daughters father for allegations regarding child sexual abuse These allegations were  SUBSTANTIATED  by CYFD  These allegations were also reviewed by Para Los  Ninos  (child sexual abuse clinic) and she was discharged with a final diagnosis of child sexual abuse My daughter was 4 at the time and still  talkes  about this incident. She is now 10! After hearing all sides (CYFD, Para Los  Ninos ,  Dectectives , etc.) Judge O’Rourke (Special  Commisioner  for Domestic Violence) enforced an Order of Protection against my daughters father and sent the case to the District Attorneys office to be heard.

Scene 4

By 2017 his attorney filed for a Re-Integration process and visitation even though the case had never been heard before the District Attorneys Office. I called the DA’s office only to be told they had “ lost ” my child’s file during a time in which they had moved all of their records to a new building. They claimed that once they found the file they would have an attorney review it. I got a call back from the DA’s office informing me that they didn’t feel there was enough evidence to hold a hearing on the case!  Let me remind you that CYFD, Para Los  Ninos , a detective, and Judge O’Rourke all believed there was enough evidence that my daughter was sexually abused ! Because of the DA’s mishandlings, My daughters father was able to begin the Re-Integration process!

Scene 5

As the re-integration process began, I was told by Mr. Bob Galligan (in front of my child’s therapist) that if I did not comply with the process I could be  thrown in jail  and that I was to make my daughter feel secure in these Re-Integration visits with her father (A.K.A. her abuser)!

Scene 6

After 2 years of this so called “re-integration process”, a stipulated order was  set in place  granting her father 50/50 custody as well as visitation but ordered that  these visitations between my daughter and her father were to take place within his parents home and to my understanding this was due to the prior child sexual abuse “allegations”.  Oh…and  yes..to  clarify…the Family Court still views and maintains that her child sexual abuse case  is merely just “allegations” even though it was  SUBSTANTIATED  by CYFD and Para Los  Ninos ! But this is not where this story ends….

Scene 7

By January of this year (2021), My daughter began to come home from her visits with her dad stating that her father had been kicked out of his parents home and he was now living with his girlfriend. She also stated that his girlfriends home had no heat and that she was having to sleep on the floor in a jacket. She claimed there was no food as well. Father would not give me girlfriends info or address in order for me to call for a “well child check” in which I decided to file a restraining order in hopes that the courts could obtain an address and allow CYFD to go in and investigate. My restraining order was granted.  However, at the same time that this was taking place…I had to move from my home in which I had resided for almost 6 years. Without being able to find an affordable four bedroom home in the Albuquerque area and down to a week to move, I settled on a home 3 hours away (WITHIN THE STATE). Her father was well aware of my move, but used the incidence to file a petition against me for “Immediate Return of Child” and to hold me in contempt of court. This was clearly done out of spitefulness due to the granted restraining order and investigation into his girlfriends home! Regardless though…this didn’t matter to Judge Ramirez. She overstepped the restraining order and ordered that I hand over our daughter to her father for visitation  (WITH THE RESTRAINING ORDER IN PLACE) or be placed in jail!! She also ordered me to move back to the Albuquerque area within 30 days or lose all my rights stating that I am not allowed to move without HER permission!!!!  No where was this in our parenting plan and let me remind you I didn’t even leave the state!

Scene 8

Due to Judge Ramirez ordering that he have visitation regardless of a restraining order in place and a CYFD investigation being conducted, as well as threatening me with jail…I dismissed the restraining order so that I would not be held in contempt for violating the restraining order. They then flipped this on me and stated I dropped the restraining order because I filed it falsely and intentionally in order to flee the county I was living in!

Scene 9

Judge Ramirez then ordered that me and her father (as well as our daughter) attend Court Clinic to figure out the “best interests of my child” in regards to whom she was to live with.  But this proved to be disastrous  As well!  And quite frankly, I feel that it was a set up .

Scene 10

During one of these Court Clinic appointments between me and her father, her father literally went into the court bathroom and proceeded to punch the walls, etc. The court officers had to go in and check on him! But that was not even reported to the Judge! However…During these investigations her father and I came to an agreement in regards to a 50/50 custody and timesharing plan in which our daughter was also completely in agreement with.   But regardless of this, Renee (the court clinic investigator) proceeded to do investigations in which I paid no mind to. But what I am about to tell you next is going to shock you!

Scene 11

Our final hearing was this Friday (August 13 th , 2021). It began with Judge Ramirez asking me and the father if we had come to an agreement in which we both told her that we did.  It then proceeded with Renee reporting to Judge Ramirez how her investigations went. Renee stated that she felt that the father needed to seek therapy for himself as well as therapy for him and our daughter due to their relationship struggling. She also stated that his own girlfriend feels that he has problems with communication and needs help. On top of this Renee stated that the father and his girlfriend admitted to having PTSD and severe anxiety and that they both use medicinal marijuana for these issues, but that Renee felt they both needed to seek therapy rather than solely use marijuana without therapy. Renee also stated that father still has no transportation of his own and that he is codependent on his parents and girlfriend. She stated that my daughter told her during her interviews that she is thrilled to be attending online homeschooling through K-12 and that she loved her new home here in Portales. She also stated that my daughter would prefer to continue with a 50/50 timesharing between her father and I and didn’t want to live without her 4 other sisters. She also agreed that father and I came to an agreement that we were both happy with. Everything sounds good right? Well this is where it took a complete nosedive!  At the end of all this Renee stated to the judge that she felt that our daughter would do better in Albuquerque public schools without any evidence as to why and stated that father should be granted full custody in order for our child to attend these schools! Judge Ramirez immediately adopted the order and I lost my daughter completely!!

Scene 12

As if this doesn’t sound tyrannical enough…. I am not allowed to see my daughter except for on three day weekends! I am not allowed to see her for ANY holidays except for major holidays beginning next year! I am not allowed to talk about any of this with my daughter or else it will be considered emotional abuse! I am only allowed 3 phone calls a week to my daughter! If this is for schooling purposes…why am I so severely restricted from seeing or talking to my child????

Scene 13

Her father has a  SUBSTANTIATED  child sexual abuse case! Her father was caught staying at his girlfriends with our daughter outside the supervision of his parents home! Her father claims to have severe PTSD and anxiety! Her father had an outbreak in the court bathroom during these investigations in which the court officers had to check on! Her father still has no transportation of his own! Her father has never been involved in any of her medical care! Her father has never been involved in her special education needs! Her father admitted in court, before Judge Ramirez that he did not want to keep our daughter from her mother or sisters and felt it would hurt her emotionally! Her father and I both had an agreement! During the investigations…my other children were not even involved or considered in the matter! Renee believes her father needs therapy! Renee believes his relationship with our daughter needs therapeutical help!

NM STATUTES FOR THE DETERMINATION OF A CHILD CUSTODY HEARING STATE THAT THE JUDGE MUST DETERMINE THE BEST INTERESTS OF THE CHILD BY CONSIDERING THE FOLLOWING: THE WISHES OF THE CHILDS PARENTS  THE WISHES OF THE CHILD  THE INTERACTION AND INTER-RELATIONSHIP BETWEEN THE CHILD WITH THEIR PARENTS, SIBLINGS, AND ALL  OTHERS WHO SIGNIFICANTLY AFFECT THE CHILD’S BEST INTERESTS 4. THE CHILD’S ADJUSTMENT TO THEIR HOME, SCHOOL, AND COMMUNITY 5. THE MENTAL, AND PHYSICAL HEALTH OF ALL INDIVIDUALS INVOLVED NM STATUTE 40-4-9 (2018)

Scene 15

I am not the only case in which Judge Debra Ramirez has ruled with absolute disregard for the law and for the consideration of the child’s best interests!  A quick google search will show you that!  To my knowledge…there are lots of complaints about her! There was even a petition filed on  change.org  in regards to her removal! All those who have gone before me cannot seem to get the system to listen nor even open an investigation into her! Help us get this tyrannical Judge removed immediately!  The safety of our children depend on it!!!
