(1)It shall be the duty of every employer to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all his employees. Section 7 - General duties of employees at work. It shall be the duty of every employee while at work —
(a) to take reasonable care for the health and safety of himself and of other persons who may be affected by his acts or omissions at work; and (b) as regards any duty or requirement imposed on his employer or any other person by or under any of the relevant statutory provisions, to co-operate with him so far as is necessary to enable that duty or requirement to be performed or complied with..

HSWA is the Umbrealla act covering all health and safety legislation.

[Audio] Mangement of Health and Safety at Work Regulations 1999 states The Employer – Undertake an assessment of the risks to health and safety of their employees and others who may be affected by their work activity. Employers with 5 or more employees should record the significant findings of this risk assessment. The Employee –

 MHSWR were introduced to reinforce the Health and Safety at Work Act 1974. 
 The MHSWR places duties on employers and employees including those who are clients, designers, principal contractors or other contractors.

[Audio] The Working Time Regulations (1998) ensures the rights of workers ensuring they don not work excessive hours.
Listed here are basic right that the regulation provide.
These regulations limit the working week to 48 hours, however there is an opt out agreement in each starter pack for whoever wishes to opt out..

The Working Time Regulations (1998) ensures the rights of workers ensuring they don not work excessive hours.
 The basic rights and protections that the regulations provide are:
 A limit of an average if 48 hours a week which a worker can be required to work (though the workers can choose to work more should they want to)
 A limit of an average 8 hours work in a 24 hour period which night workers can be required to work.
 A right for night workers to receive free health assessments
 A right to 11 rest per day
 A right to a day off each week
 A right to an in-work rest break if the working day is longer than 6 hour
 A right to four weeks paid leave per year

Regulations also provide different and enhanced rights for adolescent workers:
 A right to free health and capacities assessments for night work
 A right to 12 hours rest per day
 A right to 2 days off per week
 A right to an in work rest when the working day is longer than four and a half hours.

The new rights apply to all workers except those that are self employed.

The employer must assess all workplaces/workstations, implement the necessary measures and check their effectiveness. The results must be documented. Employees are also required, among other things, under the Occupational Health and Safety Act to report any detected defects in a protective system immediately..

Basic duties of the employer under the Safety and Health at Work Act

Under the Safety and Health at Work Act, the employer is obliged to identify and assess the risks to his employees.
 A risk is where an individual encounters a danger or hazard in time and space. The employer must assess all workplaces/workstations, implement the necessary measures and check their effectiveness.
 The results must be documented.
 The following general principles apply: Risk identification/assessment is the task of the management. Hazard elimination is the most effective outcome. Hazards must be eliminated at source. There are always several risks (factors).
 Employees are also required, among other things, under the Occupational Health and Safety Act to report any detected defects in a protective system immediately.

If an employee requires medical treatment while at work. Safety is an asset to be protected!  We expect to be safe, and we take for granted many of the safety features around us. For example:
 Seat belts and air bags in cars Crash barriers on motorways  Lifeboats on a ferry or ship Competent pilots on commercial aircraft

[Audio] Always report Accidents and Incidents: Even if there is minor or even no injury Many major accidents happened because minor events were ignored We can't prevent it happening again if we don't know about it.

Accidents require a quick and efficient response Plan your response in advance Ensure First Aid cover and equipment is suitable Train rescue teams

Immediate Action: Assess the situation Deal with any danger Rescue, if necessary Call for assistance Prioritise and treat casualties Report the incident.

Always report Accidents and Incidents:
 Even if there is minor or even no injury
 Many major accidents happened because minor events were ignored
 We can’t prevent it happening again if we don’t know about it

[Audio] Fire Extinguisher Color Codes. The color codes detail what extinguisher to use on different fires. Ensure that in the event of a fire you know the correct extinguisher to use, as some of the products that we use react badly to water, the COSHH assessments identify the correct one to use. Fire Extinguishers must be inspected regularly at least every year up to 2 years by a qualified person..

[Audio] Fire prevention and fire evacuation Fire Prevention - It is a proactive method of preventing fire-based emergencies and reducing the damage caused by them.
Fire Evacuation - Fire and evacuation alarms are intended to alert building occupants that a fire or other life-threatening situation exists. Upon hearing the alarm, everyone should leave the building immediately. Property can be replaced – People cannot! Safety First!.

Fire Prevention: Comply with local rules Take extra care when handling flammable or oxidising materials Take extra care with hot work Ensure contractors are supervised and monitored Avoid damage to fire partitions (doors and walls)

Fire Evacuation: Sound the alarm Call the fire brigade Evacuate the building Report to your assembly point Be familiar with exit routes Know your fire extinguishers and how to use them Do not attempt to fight a fire unless you have been trained to do so or need to do so in order to effect escape

All sites have a different version of  risk assessment (LMRA,TOFS) you need to complete these to ensure that you identify any hazards before commencement of work

Domestic cleaning agents may involve a risk, as these too may contain hazardous substances. Food should only be eaten in canteens and break rooms, so as to prevent the ingestion of harmful substances via the digestive system. Eating with dirty hands can lead to hazardous substances penetrating the body through the mouth.
The national Hazardous Substances Ordinance (GefStoffV) regulation governs activities involving chemicals. he Hazardous Substances Ordinance is directed at manufacturers and users. It regulates occupational health and safety during activities involving hazardous substances in an establishment. One of the duties of the employer is to ensure risk assessments are carried out by a specialist. A risk assessment of hazardous substances in the workplace requires prior knowledge of the length of time employees will spend there, as the longer this period is, the greater the risks to health..

[Audio] No alcoholic or drugs are allowed on any Barrier work sites or offices. Random drug and alcohol testing can and will be carried out.
Testing can also be undertaken in the following circumstances: Just Cause. Persons suspected of being under the influence of drugs/alcohol or Accident/Incident. Post accident/incident testing.. 

Scene 31

NO alcoholic beverages or drugs are allowed on any Barrier work sites or offices.  The consumption of alcohol whilst at work is against all company policy and regulations.

Persons under the influence of alcohol or drugs shall not be permitted on any site.  Since the nature of our work scope involves high pressure equipment, fast moving plant and the use of hazardous substances, the consumption of alcohol or drugs can cause severe dangers to personnel themselves and to others working around them.

Persons who are found to have consumed alcohol or drugs or are suspected to have consumed alcohol  or drugs will  be removed from site.  In these instances disciplinary action will  certainly take place, which could lead  to dismissal.

Random Drug and Alcohol testing can and will be carried out by the company. Testing will be undertaken under the following circumstances: Just Cause – Suspicion of being under the influence of drugs or alcohol. Accident/Incident – Post accident or incident testing.

[Audio] No smoking policy has been developed to protect all employees, service users, customers and visitors from exposure to second hand smoke, and to assist compliance with the Health Act 2006. Disciplinary procedure will be instigated against any member of staff who does not comply with this policy..

[Audio] Emergency Procedures - Upon hearing a fire alarm or site sirens, down tools and leave them 'safe'. Proceed to your muster point quickly but avoid running. After arriving at your muster point, inform your supervisor and await instruction.
The supervisor will inform the evacuation co-ordinator and wait for an all clear. Muster Points

Upon hearing a fire alarm or site sirens, down tools and leave them ‘safe’.  Proceed to your muster point quickly but avoid running.  After arriving at your muster point, inform your supervisor and await instruction. The supervisor will inform the evacuation co-ordinator and wait for an all clear.

 It is for your own Safety and Welfare that you wear the PPE & RPE supplied.

 Please ensure that all equipment is well maintained and is fit for  the task, report any defects to your supervisor.

Warning – Warning of hazard or danger – These are often a black triangle with a yellow background Mandatory – Prescribing specific behaviours to follow – These are often blue round shaped signs with white pictograms
Emergency – Information on emergency exits, first aid etc. – These are often green background shaped signs with white pictograms.

risk that the upstream fuses will not trip in the event of a fault, since the total
resistance in the cable means that the trip current for the upstream fuses is no
longer achieved..

electrical systems on construction sites may only be carried out by a qualified
electrician..

On construction sites, equipment must be able to deal with higher loads and stresses. Here, power circuits with sockets require additional protection via a residual current device (RCD), abbreviated in German.

Health and Safety at work act 1974, states 

Section 2  General duties of employers to their employees.
(1)It shall be the duty of every employer to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all his employees.

Section 7  General duties of employees at work.

It shall be the duty of every employee while at work —
(a) to take reasonable care for the health and safety of himself and of other persons who may be affected by his acts or omissions at work; and

(b) as regards any duty or requirement imposed on his employer or any other person by or under any of the relevant statutory provisions, to co operate with him so far as is necessary to enable that duty or requirement to be performed or complied with.

Mangement of Health and Safety at Work Regulations 1999 states

The Employer – 
Undertake an assessment of the risks to health and safety of their employees and others who may be affected by their work activity. Employers with 5 or more employees should record the significant findings of this risk assessment.

The Employee –
Report any shortcomings in health & safety arrangements.
Report dangerous situations.
Use equipment in accordance with training and instruction.
Take reasonable care of their own health & safety and those of others who may be affected by their acts or omissions.

This regulation places duties on employers and employees including those who are clients, designers, principal contractors or other contractors.
