A Fact Finding Mission was held with EIB on 6 th to 8 th March EIB confirmed they are willing to fund both Civil, Depot (civil and equipment) and Systems (Power & Track) packages providing there is no “Make in India” restriction. EIB are willing to finance 90% of Tender Package costs for civil and supply/fix & 100% where material supply all excluding GST. EIB are considering funding Rs 3,200 Cr..

17. ADB & NDB Visit. A Fact Finding Mission was held with NDB & ADB on 6 th to 8 th March ADB & NDB agreed for the Tender documents as per ADB format and GCC as per FIDIC Yellow Book Prior approval of ADB is required before issue of NIT and post evaluation of bids (2-3 months) ADB prefer to fund the underground packages & they are ok with other part civil packages providing there is no Make in India policy NDB prefer to fund the Rolling Stock and Signalling packages, & they have no issue with the Make in India policy. However MoHUA does not permit external funding for Rolling Stock & Signalling. ADB is interested in funding the following packages; Package 3 – underground section consisting of 3.60 kms of underground tunnels and 4 nos. underground stations Package 3a – E&M works (incl. Tunnel ventilation & HVAC) for the above package NDB is interested in funding the following packages; Priority Package – 2A (Contract Awarded) – 70% Rolling Stock Signalling & Telecom Systems.

20. Make in India Policy. As per letter No .: K-14011/1/2018-UT II dated 27.07.2018 of MoHUA, GoI with subject “Mandatory Conditions/guidelines applicable to metro rail projects” addressed to The Chief Secretary GoMP and GoG . (V) (b): In order to promote “Make in India” initiative and as envisaged under Public Procurement Order 2017 mentioned above, MoHUA has rationalized minimum local content and purchase preference for procurement of metro rail system/equipment with a definitive plan for phased indigenization to the extent as detailed below: i) Minimum Local Content (as on date, increased subsequently): a. Rolling Stock – 40% b. Telecom – 40% c. Signalling – 30% d. Civil – 80% e. Electrical – 50% With the above condition tender document for any package will not be approved by the multilateral/ bilateral funding agencies including EIB and ADB..

21. Make in India Policy - EIB. EIB Procuremen t Guidelines: Local Preference for Goods: Except for operations in Candidate Countries, Borrowers may grant a 15% margin of preference for goods manufactured or produced in the country (defined as having at least a 30% local content ex-factory). Bidding documents must clearly indicate such preference. The comparison is then made between the price (net of taxes and duties at the place of delivery) of the imported good increased by 15% and the price (net of the value added tax or similar taxes) at the place of delivery of the locally manufactured good. The Bank does not allow for preference to be given to works (even if they include the supply of goods) or services originating in the beneficiary country..

The impact of Domestic Preference on a Project should be understood When considering applying domestic preference, it is vital that a thorough market assessment has been undertaken to ensure that giving preference to domestic contractors or locally made goods does not hurt competition. It is equally important to ensure that local suppliers and locally made goods adhere to the required technical, environmental, and labor standards. Wider social and economic impact should also be considered in providing domestic preference. For example, allowing domestic preference may support the development of the private sector in the borrower’s country by giving them preferences, hence a higher chance, to win procurement contracts. However, a poorly designed domestic preference scheme may result in lower quality of goods, works, or services provided by the eligible supplier or contractor. Alternately, when price preference is applied, the borrower will have to pay more for the same or similar goods or services. It can also be argued that the application of domestic preference schemes, over the long term, can reduce competition and remove competitive pressure on domestic industry to match the efficiencies of global best-in-class suppliers or contractors. The consumer bears these higher costs..

24. Make in India Policy. (V) (c) Metro rolling stock should be funded through equity/ counterpart funding/ domestic funding and not from sovereign loan from multilateral/bilateral financing institutions. Only after exhausting the counterpart funding limit for procurement of rolling stock, funding of signalling and system components from remaining limit of counterpart funding should be done. As imported component is maximum in Rolling Stock and Signalling, this will ensure that “Make in India” objective are achieved to its utmost. NDB adopts a country system for procurement hence they are willing to finance Rolling Stock and Signalling even with a “Make in India” policy..
